Lightpop — Terms of Service

Welcome to Lightpop, a digital platform, provided by Tanzanite Industries LLC, a Wyoming Limited Liability Company, that allows users to adjust the HDR properties of media. By using our website or app, you agree to be bound by the following Terms of Service (“Terms”). Please read them carefully.

If you do not agree to these Terms, you may not access or use Lightpop.

1. Use of the Service

By accessing Lightpop, you confirm that:

• You are using the service for lawful and personal purposes.

We reserve the right to refuse service, block access, or suspend accounts at our sole discretion for any reason, including misuse or violation of these Terms.

2. License & Ownership

All content, tools, images, data, software, and materials provided via Lightpop are owned by us or our licensors and are protected by intellectual property laws.

You may not:

• Reverse engineer, decompile, or attempt to extract the source code
  
• Use automated scripts, bots, or scraping tools
  

3. Modifications to the Service

We may update, modify, suspend, or discontinue any aspect of Lightpop at any time, with or without notice. We are not liable to you or any third party for any modifications or service interruptions.

4. Limitation of Liability

To the maximum extent permitted by law:

• Tanzanite Industries LLC, Lightpop and its affiliates, partners, and employees are not liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the service.
  
• The service is provided “as-is” and “as available,” without warranties of any kind, either express or implied.
  
• Lightpop manipulates media into extreme brightness values. This may be undesirable to some entities. The media may also render improperly on various devices that do not support these values. It is outside Tanzanite Industries LLC's control how other entities may respond to your media that has been edited by Lightpop (such responses may include, but not limited to: negative comments, social media unfollows, content reports, platform adminstrative actions such as reach suppression or account suspension). We will not be responsible for any consequences.
  

Your use of Lightpop is entirely at your own risk.

5. Indemnification

You agree to indemnify, defend, and hold harmless Tanzanite Industries LLC, Lightpop, its affiliates, officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the service
  
• Your violation of these Terms
  
• The consequences of posting edited media to Social Media Platforms, which may result in various consequences outside of Tanzanite Industries LLC's control. These various consequences may includem, but are not limited to: negative comments, social media unfollows, content reports, or platform adminstrative actions such as reach suppression or account suspension. Use Lightpop edited images at your own risk.
  

6. Termination

We may terminate or suspend your access to Lightpop at any time, for any reason, without notice. Upon termination, all rights granted to you under these Terms will immediately end.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law principles. Lightpop is operated by Tanzanite Industries LLC, a company based in Sheridan, Wyoming.

Any and all disputes, claims, or controversies arising out of or relating to your use of the Lightpop service—including the validity, enforceability, or scope of this agreement to arbitrate—shall be resolved exclusively through final and binding arbitration, administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules.

• You waive any right to a trial by jury or to participate in a class action, consolidated proceeding, or representative action.
  
• Arbitration shall take place on an individual basis only.
  
• The arbitration will be held virtually or in Sheridan County, Wyoming, unless both parties agree otherwise.
  

The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this agreement.

By using Lightpop, you agree to resolve all disputes through arbitration rather than through courts of general jurisdiction.

8. Changes to Terms

We may revise these Terms from time to time. The latest version will always be available on our website. Continued use of Lightpop after any changes means you accept the updated Terms.
